EU Sanctions on Tay Za's Son Upheld

BANGKOK—In a May 19 court judgment that went almost unnoticed, Pye Phyo Tay Za, the son of junta-linked businessman Tay Za, lost a legal bid to have EU sanctions against him overturned and was ordered to pay the court costs for the Council of the European Union. Pye Phyo had argued that he is neither a member of Burma's military government nor associated with it, and does not benefit from “the administration of that government.” His lawyers, London-based law firm Carter-Ruck, claimed that “neither the applicant [Pye Phyo] nor his father received any benefits from the regime.”  | | Tay Za (right) celebrates with his youngest daughter and sons Pye Phyo (left) and Htet (center). But Tay Za is widely-regarded as having built a multifaceted, multi-billion dollar business empire based on close connections with Burma's ruling military, including junta-chief Snr-Gen Than Shwe. And in a statement that may have undermined Pye Phyo's own case, his lawyers also argued that, “the fact that the applicant is the son of a person whom the Council considers to have benefited from the military regime of Myanmar [Burma] does not give him the requisite connection with that regime.” Similarly, Pye Phyo claimed that his two-year shareholding in two of Tay Za's Singapore-listed companies, “does not show that he benefited from any advantages that his father’s companies may have received from the military regime in Myanmar.” In rebutting the contention that neither Tay Za nor his son Pye Phyo benefit from the regime, the opposing lawyers said: “As regards family members of such leading business figures, it may be presumed that they benefit from the functions exercised by those businessmen, so that there is nothing to prevent the conclusion that such family members also benefit from the economic policies of the government.” In light of fears that Pye Phyo's attempt to have EU sanctions against him lifted was a ruse to enable Tay Za to find a way around sanctions, the Council said that, “the applicant was aware of the reasons for which such restrictive measures specifically apply to him, since he states in paragraph 37 of the originating application that there may be a risk of his father circumventing the freeze on his own assets by transferring his funds to other family members." Pye Phyo contended that he “does not frustrate the process of national reconciliation, respect for human rights or the democratization of Myanmar,” reminding the Council that he has not been involved in politics or government inside Burma. But his younger brother, Htet Tay Za, reportedly bragged in a notorious 2007 email, sent in response to new US sanctions on the junta, that even though "the US bans us, we're still [expletive deleted] cool in Singapore. We're sitting on the whole Burma GDP. We've got timber, gems and gas to be sold to other countries like Singapore, China, India and Russia." Tay Za often flies to Singapore on business, where both Pye Pho and Htet were schooled. Two large banks in the city-state—OCBC and DBS—have denied functioning as repositories for billions of dollars of gas revenues derived from the Yadana pipeline project. According to Mark Farmaner of the Burma Campaign UK, the case and outcome “gives an indication that stronger, carefully targeted sanctions could have an impact,” but adds that carrots should be put on the table as well as an incentive toward reform. EU sanctions on Burma were renewed under the rubric of the “Common Position” recently. The measures are criticized for being weak and insufficiently-well targeted in some quarters, while elsewhere it is argued that sanctions have not pushed the junta toward reform, and so a new “engagement” approach is needed. Still others say that it is not sanctions per se that are the problem, but the role of government and business in China, India, Thailand, Singapore and Malaysia, all of which offer political and commercial alternatives to the junta and thereby undermine the sanctions.

There will be a place and time to debate the true legacy of Bogyoke Aung San.
Calling someone "Myaunt" is neither warranted nor prudent in The Irrawaddy.
There are enough westerners here assuming this forum as a "Myaunt Pwair".
Yet we are ripping each other apart over different perspectives over a recognized hero's legacy.
While the west admitted a non-working policy yet without any hesitation declare "as a matter of fact" to continue.
In such shallow manner that anything anti- SPDC justifies any of their now proven to hurt the citizenry more policies.
Let us not excoriate each other except on matters that absolutely pertain to "lessening the suffering of the most vulnerable"
By words and deeds if we express here the westerners will have no choice but to follow suit. |

Gen Aung San, Alan Ni Thakin Soe, Thakin Than Thun are Communist party founders.
Gen Ne Win also participated but Gen Ne Win erased it from history during his era.
Results of Gen Aung San in TRUE Burma history:
(1) He brought his armed force into politics (until Than Shwe)
(2) He produced the civil war by Pinlong agreement.
(3) He transfered his true mentality (licking & polishing British shoes) to his daughter Aung San Suu Kyi. Like father like daughter..no surprise at all.
(Gen Aung San was pissed off by when the British did not accept him to polish the shoes a 2nd time, Gen Aung San was shown in public as "Anti British")
Go to the any library anywhere to read it.

You invented the history again that Gen Aung san was a "Communist Party founder" in Burma history...not a democracy icon. Are you sure? Who are the Tha Khin Soe (Red communists)& Tha Khin Than Htun (White communists)? Everybody knew many unknown people & soldiers served their lives for independence.
Everybody knew Gen. Aung San met Japanese Suzuki & led 30 comrades for military training. Everybody knows Ko Min Ko Naing, Ko Ko Gyi, Ko Htay Kwe, Ma Su Su Ngwe, Ko Thu Ya (Zagana), Ko Kyaw Thu, U Win Tin and etc are heroes of Burma. Don't you know? |

Burma's independence was achieved by the "Nu-Attlee agreement".
Yes, Gen Aung San worked very hard but without progress. Do remember, many unknown people and soliders served their lives for independent. Not only one Gen. Aung San.
Even members of the Burma Communist Party (BAKAPA) served their lifes for independence.
Saying Gen.Aung san is the ONLY hero means "Rambolism". Not correct.
Now, where have you placed "Ko Min Ko Naing, Ko Ko Gyi, Ko Htay Kwe, Ma Su Su Ngwe and etc..? They are serving their lives in prison. You forget.
Gen Aung san was a "Communist Party founder" in Burma history...not a democracy icon.
Gen Aung San was not a simple man, agreesive for confrontation with complex minds between Communisim and Socialism.

Japan made problems for Gen.Aung San. So, he went to British to show his shameless face again. He tried to polish British shoes second time. British did not accept him and finally he was assassinated.

Thanks for your reply.Did you believe Gen. Aung San would surely implement the genuine democracy? What was his ideology? How did he make out Pinlung Agreement with the ethnics? When selected 30 men (called Yebawtungkyeih in Myanmar terms) fled to Japan led by Aung San for military training,how were they told by their trainer, Japanese major. Every sentient being understand all the citizenry of Burma are in deep suffering unspeakably. Everyone,in a pure thought, must salute the sacrifices of Aung San,U Thant, U Win Tin and Aung Naing Oo who you show up. More than words can tone up. There must be a lot more to be saluted at all. However,lie, most amazing, is the rooted culture of Burmese for nowadays as independence was gained corruptedly not by the genuine way. I don't want to mention if you agree with me or not. It's time to reveal the truth about Burman history which has been kept hidden and unreadable for most of the miserable citizenry for decades. |

SPDC claimed that "no one is above the laws" but like Tay Za is forever above the SPDC laws.
Our SPDC is not only the Military Junta but also becomes as " Taliban militants" to public by giving cultural reasons.
Yes, SPDC dared to critize the poor Bikini model and also to Actress Su Shun Lae, Eidra Kyawzin and Wutmon Shwe yi because of wearing the short shirt...
But SPDC Generals afraid to say somthing to Tayza & his family (his daughter). |

You need to be reviewing the articles on Bogyoke Aung San, U Thant and living ones like U WIn Tin and by Aung Naing Oo here in The Irrawaddy. Be reminded of their dedication and tenacity.
There needs to be a self-limit to denigrating one's own kind in public especially down to the genetics.
If you feel hopeless say so but please refrain from condemning 90% of Myanmar citizenry barely surviving under the most adverse conditions 2nd only to N. Korea meted out by western governments.
While you blame your brothers within and praise Muslims outside, did you think about the part the west play in Myanmar's fate?

It is tragic to know the enormity of hate between the haves and have-nots. The poor people, the majority have to live in their own country in economic apartheid harsh conditions.
The haves are represented happily by the junta, cronies, families and friends. The have group also have a lack of trust among themselves and always have to watch their back all the time.
One day, the majority have-nots will rise up in the great proletariat revolution and we will see a blood bath, mass killing of the have family.
Inequality and unfair treatment suffered by the oppressed are too much to bear for daily life. You could feel the anger of people merely seeing the comfort life of the haves. One day this anger will burst out of control and I am sure the have are well prepared to flee the country when the time arrives.
The bloody day of Burma will come unexpectedly. The hate is cancerous. |

The world truly knows what's going on in the military-led country. The regime and all businessmen and women and those who are involved in making the country impoverished and unquenchedly sucking the people's blood have learnt the days of their punishment are under way. Maybe, like Saddam Hussein or worse than his sentence.
I am so sorry to say that 90% of the Burmese people are too selfish and can easily be satisfied while their fellows are bitterly suffering and in pain. I am so sure that they have been successfully influenced by the bug of 4 decades military leading.
I wish Burmese people could have ebullient courage like Muslims.

Hypocrisy!
Why is the English law firm defending the 'thief'? This is sheer hypocrisy;sanctions on the one hand and making money from the thieves who had stolen from Burmese people. Aiding and abetting criminals amounts to committing crime too.
Now, if any of you are intelligent, find out who instructed the English law firm to act for the defendant. Look at the details of the processes involved. Which European Union law was applied? Which English barrister did the defence?
Come on, get in touch with Carter Ruck and demand the details. Was the Burmese ambassador to the UK used as liaison between the lawyers and the defendant? Under whose authority? These are substantive issues you must not ignore.

This personal gripe of brother against brothers IN PUBLIC needs to stop.
The Irrawaddy a forum for Myanmar is also INFESTED with others who know or care to know the true nature of a country beyond blaming theSPDC.
They look to your post as example and get the false impression of "It's ok as long as it is anti-SPDC only".
It is never OK to be ignorant foreigner to advocating for acountry of 60 million whose future has not improve through their useless advocacy.
The SPDC is our worst nightmare. Because of having loved ones and friends inside Myanmar worrying everyday under what ifs while these casual posters spit on the "Bastard SPDC" and think they help.
In fact they only accomplish 3 things:
1) Justify and prolong all anti-SPDC acts of the west and the opposition.
2) Detract us from the continuing SINS of their useless careless policies. Shown here by example of health care need.
3) Restrain us to look for troubles ahead. N. Korea.
No help to the plight of Myanmar Citizenry.

Yes, something like, during the 1988 nation- wide uprising in Burma, tens of thousands of unarmed protesters were shot down in the cities' streets by the Tatmadaw troops, which made the world stop selling weapons to the Burmese junta; nevertheless, Tayza managed to help the junta by buying weapons through his private company in Singapore.
{Right JOB at the right TIME, indeed!} From then onwards, whenever SPDC ministers went abroad to buy weapons, Tayza always accompanied the generals as an adviser. |

Thank you for boldly sharing some well known facts among the native, absolutely unfamiliar to most non-native posters.
Tay Za's generosity towards everyone he came into contact with command a loyalty without guns, in contrast to his master!
This is not to praise Tay Za. Nor is it meant to dignify or justify his present status.
However, as you clearly point out the human side of Tay Za to the outside world, the heavy cross of a sick child he is carrying.
This man has at least all the means unavailable to ordinary citizenry to mitigate his sufferings.
Much more tragic stories abound within the common citizenry. These are the most vulnerable ones.
Just as putting Tay Za continually on the sanctions list does not lessen his burden of his unfortunate child, neither justice nor compassion shown through sanction against Myanmar consider the fate of countless others who are carrying similar burdens.
Sanctions affect health care delivery in Myanmar. Google "You be the judge".

For some of us, the Tay Zas may look happy, but the truth is that Tay Za has got his own problems like everyone us. He once confided to one of his employees, while doing logging in Karen State, that he had got everything in his life, except one thing. His youngest daughter, at least in the past, had to fly to Singapore every month to get medical checkup because of some kind of congenital problem.
Some of us may despise Tay Za, but there are many things that we can learn from him. He himself may not really know anything but does know how to manage people and take advantage of their abilities. For instance, he doesn't really speak English well. So, he hired a Karen guy who grew up in Burma but has an excellent command of English and takes him with him whenever, at least in the past, he went on a business trip abroad. He knows how to treat his staff, business associates and army officers. And he is a soft-spoken person and handsome too. That's why his wife eloped with him.

The old traditional way of Chinese banking system is still working very well in every corner of the world. This includes money exchange, transfer etc...with very fast service, cheaper fees and far better exchange rates than the normal bank. There is also no limit of amount transaction.
Thus sanctions can only work in some degree but it's worth it to continue and adjust its tactic from time to time.

| Good news. At least the EU is consistent. Burmese dissidents in the UK should take notice of this London law firm Carter-Ruck and also see how the squeaky clean image (no spitting!) of Singapore (a British Commonwealth country) is just a total scam. They do business with the junta pepole all the time. There are so many Burmese "crooks", not just Tayza, with ties to Singapore (with false names perhaps). After China, Singapore is the next country, that Burmese opposition groups should target about this blatant hypocrisy. |

Does the EU apply the same rule to the #1 dictators?
Choosing again to score only political points really shows the sincerity of the EU desire to "engage" instead of the failed SOS.
Total, an EU company a source of life for early SPDC wealth, never was brought up.
Has any one seen the EU sanctioning France for doing business?
Notice all of the culpable countries mentioned here listed are ASIAN.
Another farce that make the EU a hypocrite.
If the west wishes to freeze SPDC assets in Singapore it could have done so easily through present laws.
Why has the west not done anything significant towards that end?
Ask oneself what the SPDC might do if that happende?
This is another element of Present Myanmar Quagmire.

Good. This rich young man should hang his head in shame in 2010, for partying and spending money taken from others while so many suffer.
Of course the families are part of the story! Unless they object to how they acquired their wealth, and refuse to do anything else but fight for justice for all people in Burma, then they are very much a part of this travesty.
It is part of the gradual downfall of such archaeic brutality that rich kids are held accountable also, unless they are minors. He is old enough to know morality, the value of a human life,and simple human compassion.
But surely we learnt all this in Germany in World War II? What is outrageous is the continued arrogance and excess in the face of such widespread human suffering! Do they think the world does not know? |

| It is the common knowledge that Pye Phyo and his family directly benefitted, financially ,from the generals of Burma and there are tons and tons of EVIDENCE. (The law firm in London must have known this but still encouraged Pye to pursue as the firm has nothing to loose.) Anyway, Pye Phyo and his billionaire father can well afford to pay the court fee demanded by the Council of the European Union. |
