Suu Kyi Responds to November Release Comment

In a meeting with her lawyer on Thursday, Burma's detained pro-democracy leader Aung San Suu Kyi said that the Burmese Home Minister's recent comment about her release this coming November is an obstruction of the legal process while her lawyers await the court's decision regarding the final appeal against her current 18-month period of house arrest.

“She said this kind of statement about her release can hinder the decision of the court regarding her final appeal,” said lawyer Nyan Win, who met with her from 1 p.m. to 3:30 p.m.

On Jan. 21, the Burmese Minister for Home Affairs Maj-Gen Maung Oo told local officials in Kyaukpadaung Township that National League for Democracy (NLD) leader Suu Kyi will be released in November when her term of house arrest expires. He also said that NLD deputy leader Tin Oo will be released when his term of house arrest expires on Feb. 13.

“Suu Kyi said this kind of statement [by Maj Gen Maung Oo] is absolutely inappropriate while the decision of the court is still pending,” the lawyer said.

“She used strong terms when stating her opinion about this,” he added.

Maung Oo also told the local officials that the election will be free and fair and that there will be no cheating.

Burma's highest court heard final arguments by Suu Kyi' lawyers on Jan. 18 against her extended house arrest. No ruling was made and a decision is expected within the month.

Nyan Win said he discussed with Suu Kyi the necessary legal steps to pursue while continuing her appeal. He also said they discussed the case concerning the house repairs that Suu Kyi was forced to suspend due to an objection by her brother, Aung San Oo, who lives in the United States.

According to Nyan Win, Suu Kyi suspects that there could be some sort of dishonesty involved or even a conspiracy behind the objection to her house repairs.

Nyan Win said Suu Kyi is living in a house that is unsafe because the ceiling was removed during the renovations.

“The whole house will be drenched if it rains,” Nyan Win said. “But she did not grumble about her situation.” He added that the Nobel Peace Prize laureate is in good health.

The lawyer said he asked for a copy of the objection letter from the Rangoon municipality, but had received nothing to date. “We will approach the Yangon [Rangoon] municipality and suggest the objection is not in accordance with the law,” he said.

Nyan Win said that the pair also discussed the NLD's plans to expand and ways to strengthen the party.

The NLD must communicate with people, visit people whenever they can, travel across the country without provoking. In my view, the Tuesday prayers are totally useless, instead they must communicate with the people, telling, informing and explaining the people what Aung San Suu Kyi attentions are in every possible occasion.

U Win Tin's trip to Mandalay shows NLD is no longer in idle mode. Beware old hero! I am praying for you.

NLD youth wing could come in handy leading the campaign, spreading the word and calling for Shwegondaing Declaration as basis for Burma's democracy among the populace.

Of course the undertaking should be discreet and in low key at all times.

Dead heroes and martyrs rest in their graves only and inmates in prisons will fare no better as well, lest NLD forgets.

It is best to go down fighting than getting caught and shot.However there is always TOMORROW and die another day than throw your life away today.

Your choice of course!

Calling Aung San Oo a bastard son of late Gen Aung San's on my part is in sync with all the people in Burma, you bet?

And heaping injury on insult on his own younger sister being bullied and abused by rogues in front of his very eyes deserves far worse name calling.

No doubt Burma today is run by Than Shwe's laws not Buddha's as evidenced in the aftermath of 2007 Saffron Revolution.
Pursuing his own legitimate interest at the expense of driving his own helpless sister onto the streets certainly runs counter to his professed religion, ethics as a man, a Buddhist, an elder brother and son of Burma's founder and father Gen Aung San.

Than Shwe's laws state that anyone including pro-democracy activists who left the country and took measures to dislodge his military rule like me and others and who gave up their citizenship and lived in alien lands like Aung San Oo have no property rights and others whatsoever in Burma.

COMMENT: to call him a bastard is sinking to the lowest depths of ignominy. As for the use of 's after San, this is proof of illiteracy.

COMMENT: such a travesty of natural justice. It is not Than Shwe's law;it is BUDDHIST law of inheritence—surviving siblings share the estate equally. LOGICALLY, rent since 1988 must be debited to the occupant's personal account; half credited to her personal account and half to Aung San Oo's account. THEREFORE Aung San Oo's claim MUST be for half of the capital value of the estate and half of the rent since 1988. That is justice!No one is above justice—politician, soldier or anyone.

COMMENT: Truth? Truth blind to justice. To insult a third party, pursuing his own legitimate interest, itself is proof of cognitive dissonance.

Maung Oo is just depleting our already dwindling reserves of oxygen in the air by jumping the gun ahead of court decision.
Of course he is only Than Shwe's mouthpiece and no doubt there is a conspiracy in this matter as well.

Certainly, that bastard son of Gen Aung San's has no right much less occasion to claim any right or possession on the dwelling at University Avenue where Daw Suu is calling home today.

Truth is he is a wife fearing dumb and a pawn used by the monk murderer just to make life miserable for Daw Suu only.
This evidenced the fact there is no rule of law other than Than Shwe's in Burma to say the truth also.

Daw Suu's appeal will fare no better than her existing predicament trust me.
She is going along just to highlight the point that Burma's judiciary is in the hands of the thugs at Naypyidaw only.

And they will get no papers from the municipal office also, as Daw Suu is destined to spend the rainy season in a house with no roof as planned in the first place.

Maung Oo is aware inappropriateness of the statement. But he was forced by Than Shwe to say so, who also knows it is against the law. Then why they did?
(1) Apart from “searching fire” they don’t have another card to play. Knowingly wrong to use this method yet apply for dilute political pressure demanding for release DASSK.
(2) They are not sure how to play unfair game without loop hole. In other words, no one among them except Maung Oo “bravely” to hint that DASSK will not be released soon. It is also buying time for delay of poll program.
(3) Chinese Vice President encouraged: No reconciliation, no fix for Constitution, and let alone “fair election”. These are Than Shwe’s message to EU, UN, Asean, US, NLD and Burmese people.
(4) There is a saying “curling tail cannot be made straight”, Junta never think of giving up “live in open sin”.

Therefore, do NLD and international community prepare to chop off the curl tail or swim together in the sin pool?

The point ASSK is trying to make here, by going back to court and the statute book as often as necessary, is that there is no rule of law or due process in the generals' Burma.

Does her brother Aung San Oo still carry a Burmese passport? If he is no longer a Burmese citizen, then he no longer has property rights in Burma. And if he has, he also has a duty to keep the house in good repair so it is fit for human habitation.

Nobody will be surprised to see double standards in operation here in his favor and to punish the lady.

As a crony of Than shwe, the minister had carelessly spoken out about the release date of Daw Suu even before the court had not reached any decision about it. The rule is made by Than Shwe and the minister knew too well about the condition of rule of law in Burma. The rule come from barrel of Gun according to bandits in the uniforms. IT PROVE THAT THAN SHWE HAD DECIDED ABOUT ANY FAITH OF DAW SUU. IT IS BEYOND DOUBT THAT THAN SHWE IS THE CRIMINAL IN CHIEF OF BURMA.

Daw Suu has been living in Burma for not less than two decades. She should know what is law in this country; it comes from the mouths of some ruling generals (what they say is law), but not from the judiciary.

However, NLD must talk about the sensitive things which the other political forces avoid to talk, such as about “amending the constitution” before, during and after the Elections. The minimum requirements for NLD to stand in the Elections must be very clear. This kind of things: all of NLD members must talk, inform and explain the people whenever they can and each time an occasion rise up. NLD must be among the populace.

People support NLD because of their firm position against the oppressive regime. NLD must show it always and they must be among the people.

It is very good that Aung San Suu Kyi delivered a strong comment over Major General Maung Oo’s sayings through her lawyers. She must be proactive all the time.

She and her party NLD must set out clear conditions for the elections even if there is ShweGoneDaing declaration. Besides, the NLD must show it’s strength – it must show that they have people's support – the recent trips of U Win Tin was a very much encouraging one.

The NLD must communicate with people, visit people whenever they can, travel across the country without provoking. What has she got to grumble about? The rich lady with millions in her offshore bank account.

Worrying about getting drenched in when it rains? Think about those poor unemployed people who dont have a home to live anymore thanks to her inconsiderate call for sanctions. What about their grumble?

Why dont you write about these people instead of always focusing on celebrity politicians like Suu Kyi.

Then and again, the junta has shown its disrespect for the law. It is irrelevance or negligence. Maybe it was intentionally done to get two birds by one stone.

It spoke publicly while it intervenes in the court's decision secretly. By doing so, they can see the responses, particularly from the international front.

The opposition always jumps to justice whenever it gets improper treatment. That way is part of counter-attacks apart from speaking out to foreign media. However, justice in Myanmar is already bent if not twisted. Courts are jailing people as per the government's wish-lists and do not release them even when their jail terms ended.

Administrative authority supervenes over the code of justice in Myanmar. A groundless decision is expected on Daw Suu's appeal.
