Burmese Parliament to Review Controversial Constitution

RANGOON — Burma’s Parliament took the first step on Friday towards the possible amendment of the Constitution which was drafted under a military regime and bars Nobel laureate and opposition leader Aung San Suu Kyi from the presidency.

The Constitution, ratified after a rigged 2008 referendum and widely seen as undemocratic, disqualifies presidential and vice-presidential candidates whose spouses or children are citizens of a foreign country. Suu Kyi’s late husband, academic Michael Aris, was British, as are their two grown-up sons.

The Constitution also reserves a quarter of parliamentary seats for military personnel chosen by the armed forces chief.

The review was proposed by Aye Myint and Thein Zaw, both former generals and senior members of the ruling, military-backed Union Solidarity and Development Party (USDP), said Ohn Kyaing, a member of Suu Kyi’s party.

Military delegates also voted in favor of the proposal.

“They seem to have realized that it’s essential to amend the present constitution for the country to build genuine democracy,” Ohn Kyaing said.

The junta stepped aside in March 2011, when President Thein Sein took office after the USDP swept a 2010 general election. He has opened up the country and started to modernize the economy.

Suu Kyi’s National League for Democracy (NLD) boycotted the general election but she and 42 colleagues won by-elections in April last year to take seats in parliament. She has made amending the constitution a priority.

The review could lead to changes that would make it possible for Suu Kyi to become president after a 2015 general election that the NLD is expected to win. It might also decide the future role and political scope of the military.

A review committee would include members of many political parties and outside experts, a senior parliamentary official said.

A military lawmaker, who asked not to be identified, welcomed amendments that might remove obstacles for a Suu Kyi presidency.

“Personally, I’m sure she will make a capable leader,” he said.

  1. DASSK can be next Burmese president if all ethnics support her in next election. Has DASSK military power or not? Don’t forget the right of return of all Burmese refuges to Burma for re-settlement as it was and is caused by bama military thugs in history. Most oversea returnees will support DASSK who made visit for those and gave reassurance. Thein sein offers only Burmese doctors and engineers to come back to help Burma. That is a great difference between DASSK and thein sein , USDP.

  2. The wisest thing in the world is to cry out before you are hurt. It is no good to cry out after you are hurt. People talk about the impatience of the populace; but sound historians know that most tyrannies have been possible because men moved too late. Now is the time to cry out about this lousy CONstitution!

    • Hear, hear. People who exhort others to have patience are not on the receiving end of injustice, nor deprived of their homes and livelihood themselves. The Burmese nation has been more than patient, nay downtrodden, for the past half century. Democracy or bust.

  3. The constitution was drafted just to protect the interest of Than Shwe and his USDP and just to block the ones who they do not like them from holding the highest position. It is so ugly and unacceptable. The best thing is to rewrite the whole constitution to serve the Union of Burma, amendment may not be good enough. The whole constitution is just a trash(I read them all).

  5. Typical regime action. In response to popular outrage, in this case over Suu Kyi and Letpadaung, make an appeasing announcement, over which nothing will subsequently be done. It’s just taking the lid off a boiling pot.

  6. Looks like she has become so acceptable as one of them the military is happy to let her take office in due course.

    If power corrupts and absolute power corrupts absolutely, her own release from house arrest, then a seat in parliament and even chairing a committee as the fall guy for Thein Sein (nowhere near any ministerial office yet, just a little sniff at it), all of that has already gone to her pretty little head. Never mind the past and ongoing injustice visited upon and impoverishment of the sons and daughters of the soil, our food growers and benefactors, her own Burmese majority in the heartlands of Burma.

    Quite willing and prepared to sell them down the river for her own advancement to high office. Don’t you all dare rock the boat and spoil my chances of becoming president. Xiè-xie and salute. Well and truly impressed.

  7. Most Burmese refuges and oversea Burmese are not the threat of Burmese nation. Most leave and left the world most poorest and suppressive country, Burma for survival. Change the Law to let them come back Burma step by step and gradually for re-settlement whether those are rich or poor or educated. If Than shwe and thien sein still are paranoid to fear those own people abroad as well as want to control the all business ( monopoly) under military or ex-military persons ( U pai) or cronies, foreign investment ( big companies) will not come in Burma. Thein sein needs to go abroad to beg and beg foreign investment with his cheating mouth piece of than shwe ( no more killing kachin and Rohyingya, faked peace process for all ethnic minorities, promise to let oversea Burmese to come back to help Burma, no more military contact with north Korean, faked promise to DASSK for next Burmese president, no cronies, no monopoly, no more sky rising property and industrial prices -all will turn out to be faked very soon)

I do not know the constitution is blogging those of who’s family members were foreigner and they are not entitle for President or Vice- President post but Aunt Su has one excuses for becoming President or Vice- President post because ,she is the daughter of Myanmar National leader General Aung San. That make her to qualify for President or Vice President post.

  9. The Constitution must be rewritten by Elected MPs (must include ethnic MPs) and Constitutional lawyers.
    If the Military wants 25% of Parliament seats automatically without entering Election and then those 25% Military persons can not vote in Lower House and Upper House legislation.
    Than Shwe’s Constitution was not written for Country or peoples of Burma.
    That Constitution is 100% guarantee protection for Than Shwe and his cronies’ crimes.
    No one should stay above the law and no one should get away with their crimes.
    The country Constitution should not be protection to someone who committed many crimes.
    Burmese way to Socialism was failed under dictatorship Ne Win and we do not want another Burmese way to Democracy. We do not want to see Green Uniform men sitting in the parliament for nothing but they are just guarding for Constitution which give full protection to war criminal Than Shwe and his family. The Constitution must be rewritten as soon as possible.

    • 100% agree with you. We do not need (ex or not ex) green uniform in parliament. Army is servant for public in Burma. Army is not qualified to be politician, rulers, businessmen. All Ex army are killers and suppressors in Burma history now and then. Current army is than shwe’s private bama army.

    • Cheers! Elected members alone must occupy seats at both Hlutdaws. All ministries including Defense Ministry must be under executive branch(Under the direct control of president).

  11. When does the law will come out for the permission of Oversea Brumese returnees and refuges as it is promised by thein sein?. Most those ovesea Buremse leave and left the world poorest country , Burma is just for survival from the poor management of Burmese economic policy as well as suppression of Bama military thugs. If than shwe and thein sein are still parnoid to those ovesea Burmese, foriegn investors will be more fear to come to invest in Burma as well.

  12. Interesting that it is Aung San Suu Kyi’s presidency that is here seen as the main issue with the constitution rather than, say, ethnic rights.

    More and more people are losing faith in the Lady who seems to be under perpetual shower of gifts and titles while large parts of the Union are gripped in disastrous wars, causes of which could be solved with sufficient political will.

    Even as an outsider, it hurts to see Aung San Suu Kyi look past these issues towards the presidential seat.

  13. Well Suu Kyi is only worried about that one clause in the constitution (about her two sons being non-citizens). I don’t think she is asking for a total overhaul (what about citizenship laws? She might get “rewarded” after all, for being a “nice girl” (in Than Shwe’s words!) but she still has to win more brownie points (dams?) from the Chinese paymasters.     So, that’s the GIMMICK/SETUP I see!
    The Wan Bao-UMEHL joint venture REPORT was the TRADE IN/PATHWAY for Suu Kyi’s POSSIBLE SHOO IN as the next OCCUPANT of the Burmese PRESIDENT’S HOUSE at Naypyidaw folks.
    The REPORT DID NOT MENTION WHO IS RESPONSIBLE for the FIREBOMBING – using PHOSPHORUS INCENDIARY DEVICES – of the Buddhist monks and people, NOT to MENTION GIVING COMPENSATION as RELEVANT and WARRANTED in the first place as well on the AGGRIEVED PARTIES (victims) BURNED and MAIMED including loss of eyesight and not the least SCARRED for LIFE as well.
    And WORST of ALL is the REPORT FAILED to MENTION the RETURN of ANCESTRAL LANDS to RIGHTFUL OWNERS (farmers) who have LOST their LIVELIHOODS as a result of the LAND GRAB by the Chinese and the Burmese generals of course.
    Most heinously as well is the fact: The people and farmers who owned the lands and made their livelihoods as farmers and fruit growers by profession and independently as well were PROMISED the LIFE of SLAVES, under pay of the Chinese communists and the Burmese generals no less.
    Simply put: the CHINESE COMMUNISTS HOLD the KEY for Burma’s DEMOCRATIZATION on the other side of the coin and as evidenced as well, if you guys HAVEN’T COTTON ONTO the IDEA yet.
    Told you guys the Chinese communists WOULDN’T LET GO of Letpadaung Copper Mine Project on many occasions past as well.
    Copper is NOT the ELEMENT/METAL the CHINESE are AFTER, trust me, in that area man!
    Remember, China NEEDS VITAL RAW MATERIAL (uranium) for MAKING WEAPONS of MASS DESTRUCTION and to POWER its NAVAL VESSELS and WAR MACHINERY non-negotiable and vital for its AIM of WORLD HEGEMONY.
    Of course BURMA is STRATEGICALLY PLACED and coupled with the country’s VAST NATURAL RESOURCES SERVED the Chinese communists’ AGENDA handsomely and rightly for that matter as well.
    The OBAMA led WEST has RAISED and GROOMED the BRIDE of course.
    And the BRIDE HAS ELOPED/RAN AWAY with the CHINESE communist peasant/pauper today, after a brief meeting at the Naypyidaw only, recently and unbelievably as well.
    Of course Than Shwe/Thein Sein led lot at Naypyidaw CO-CONSPIRED in the AFFAIR, any bets?
    And the PEOPLE have LOST their LEADER, LANDS and LIVELIHOODS as well while MORPHING/TURNING into PROSPECTIVE SLAVES – given JOB OPPORTUNITIES according to Suu Kyi – of the Chinese communists next door despite the fact and their BIRTH RIGHTS as INDEPENDENT PEOPLE living in a SOVEREIGN STATE/COUNTRY, ENDOWED with FERTILE LANDS and VAST NATURAL RESOURCES to CALL their OWN since the DAWN of TIME until their LANDS and NATURAL RESOURCES were GRABBED, LOOTED and ROBBED by Than Shwe led MOB at Naypyidaw for the Chinese communists today.
    Hence, Suu Kyi has SOLD THEM to the Chinese communists and generals owned UMEHL joint venture via the Letpadaung Copper Mine Report IN RETURN for the GUARANTEED POST of the President of Burma after the next election in 2015 or maybe sooner for that matter, any bets?
    U Win Tin has said recently, “as long as the Burmese military is in the picture, Burma will not get democracy and freedom” at the 25th anniversary of Phone Maw’s death (Burma Human Rights Day) lest people forget.
    Today Suu Kyi has BANKED ON the Chinese communists next door and Than Shwe’s clerk and OPTED for her SHOT AT the post of the PRESIDENT of BURMA at the EXPENSE of her long standing CHARACTER, CHARISMA, COURAGE and INTEGRITY as well which HER PEOPLE and COUNTRY including the GLOBAL COMMUNITY as well HAVE HEAPED much HOPE and BELIEVED IN.
    Hence, she has LET the PEOPLE DOWN and OPTED to FAVOR the Chinese and military owned joint venture at last.
    Recent rumblings of POSSIBLE AMENDMENTS/CHANGES to TAKE EFFECT in the military drawn Nargis constitution to suit the purpose of giving the top post to Suu Kyi has ANSWERED the QUESTION in respect to her BETRAYAL on the PEOPLE at Letpadaung area and in the country as well no doubt.
    And Min Ko Naing and his colleagues have PUBLICIZED to FORM their PARTY and JOIN the FRAY (contest the 2015 election) FINALLY.
    Hence, the FINAL BATTLE for BURMA’S DEMOCRACY and FREEDOM would be FOUGHT BETWEEN Min Ko Naing led lot (party) and Suu Kyi coalition (NLD and USDP) backed by the Burmese military and the communists in Beijing mainly of course.
    And I WOULD PUT MY MONEY on MIN KO NAING of course as HE HAS the PEOPLE of BURMA behind him since day one until today.
    Suu Kyi would be on the WRONG HORSE as well just you wait and see.
    The 2015 ELECTION WOULD BE Suu Kyi’s WATERLOO any bets?
    However, the QUESTION still REMAINS.
    WOULD the Burmese MILITARY GO BACK to the BARRACKS and HONOR the ELECTION RESULTS?
    I WOULDN’T PUT MY MONEY ON THAT of course you bet!
